Details of requests and complaints submitted to our Company directly or indirectly.

Marketing Information

Cookie records, pages viewed via Company applications, shopping history, information obtained through surveys and campaign activities.

Data Stored on the Device

Contacts, photos, and other authorized data stored on the phone, tablet, or other devices used to access the application.

2. Purposes and Legal Grounds for Processing Your Personal Data

Personal data collected by UPT in accordance with Articles 1 and 2 of the Law, and listed in detail under Article 2 of this Policy, may be processed, transferred, and stored by UPT and/or real and legal persons, including representatives authorized by or in cooperation with UPT, in line with the purposes set forth below and the personal data processing conditions and purposes specified in Articles 5 and 6 of the Law.

3. Method Of Collecting Your Personal Data

Personal data is collected through methods that are fully or partially automated, or non-automated, in accordance with Articles 1 and 2 of the Law. These methods include, but are not limited to: information and documents shared directly by you or by persons authorized to act on your behalf; through our direct representatives, providers, and/or business partners; connection information recorded as per legislation during the use of our UPTION application, website, and social media accounts; electronic contact forms filled out by you; other forms completed at our workplaces, offices, and representative branches; written or verbal communications established with our Company through online channels; information and documents sent to our Company via email, fax, or letter; information and documents shared during conversations with the call center via telephone or directly with our Company and/or our business partners and representatives; any contracts signed with our Company; and personal data shared verbally, in writing, or in electronic format through any other means.

5. Your Rights Listed in Article 11 of Law No. 6698

As personal data subjects, should you submit your requests regarding your rights through the methods outlined below, UPT will conclude your request as soon as possible and within thirty days at the latest, depending on the nature of the request. Any costs incurred by our Company to fulfill your requests may be charged to you according to the tariff specified in Article 13 of the Law titled "Application to the Data Controller."

In accordance with Article 11 of Law No. 6698, regarding your personal data processed by UPT, you have the right to;

Request information if your personal data has been processed,
Learn the purpose of processing your personal data and whether they are used in accordance with their purpose,
Know the third parties to whom your personal data is transferred domestically or abroad,

Depending on the nature of your request, information and documents that allow for identity verification must be provided to us completely and accurately. If the requested information and documents are not duly provided, there may be disruptions in the full and qualified conduct of investigations to be carried out by UPT based on your request. KİŞİSEL VERİLERİN KORUNMASI KANUNU HAKKINDA AYDINLATMA METNİ

Bu metin, 7 Nisan 2016 tarihli ve 29677 Sayılı Resmî Gazete’de yayımlanan 6698 sayılı Kişisel Verilerin Korunması Kanunu (“6698 sayılı Kanun”) hakkında, veri sorumlusu sıfatıyla UPT Ödeme Hizmetleri ve Elektronik Para A.Ş. (“UPT”) olarak sizleri bilgilendirme amacıyla hazırlanmıştır. Kişisel verileriniz; Şirketimiz ve/veya şubeleri tarafından, aşağıda açıklanan kapsamda toplanacak ve işlenecektir.

Şirketimiz Tarafından İşlenen Kişisel Verilerinizin İşlenme Amaçları; Kişisel verileriniz, özel nitelikli kişisel verileriniz; aşağıda belirtilen amaçlar ve hukuki sebepler gibi ancak bunlarla sınırlı olmayan benzer amaç ve sebeplerle işlenmektedir.

Kanunlarda açıkça öngörülmesi ve hukuki yükümlülüğümüzü yerine getirebilmemiz için zorunlu olması halinde;
- Kimliğinizin ve adres bilgilerinizin tespit ve teyit edilmesi,
- Müşteri bilgilerinin doğrulanması ve güncel olmasının sağlanması,
- Risk analizi yapılması,
- Risk yönetimi ve bilgi güvenliği süreçlerinin yürütülmesi,

- Tüm faaliyetlerimizin Kişisel Verilerin Korunması Kanunu, Türk Borçlar Kanunu, Suç Gelirlerinin Aklanmasının Önlenmesi Hakkında Kanun, Türk Ticaret Kanunu, Avukatlık Kanunu, Türk Medeni Kanunu, Ödeme ve Menkul Kıymet Mutabakat Sistemleri, Ödeme Hizmetleri ve Elektronik Para Kuruluşları Hakkında Kanun, İcra ve İflas Kanunu ve Türkiye Cumhuriyeti Merkez Bankası Kanunu ve burada sayılan mevzuatlarla sınırlı olmamak kaydıyla hukuka uygun yürütülmesi amacıyla,

Şirketimiz ile aranızda bir sözleşmenin kurulması veya ifasıyla doğrudan doğruya ilgili olması ve hukuki yükümlülüğümüzü yerine getirebilmemiz için zorunlu olması halinde;

- Şirketimiz faaliyet alanı içerisinde sağladığımız, aracılık ettiğimiz, ödeme hizmetlerine ilişkin yükümlülüklerini ve sorumluluklarımızı ifa edilmesi ve sözleşme süreçlerimizin yürütülmesi,
- Şirketimizin ürün ve hizmetleri ile ilgili olarak reklam, kampanya ve promosyon süreçlerinin yürütülmesi ve bu amaçlarla tarafınızla iletişime geçilmesi,
- Ürün satışı, bülten gönderimi ve bilgilendirmelerin yapılması, pazarlama faaliyetlerinde bulunulması,
- Müşteri memnuniyeti çalışmalarının gerçekleştirilmesi ve hizmetlerine ilişkin tekliflerin paylaşılması,
- Müşteri ilişkileri yönetim süreçlerinin yürütülmesi,
- Ürün ve hizmet satın alım süreçlerinin ve bunlara ilişkin destek hizmetlerinin yürütülmesi,

Bir hakkın tesisi, kullanılması veya korunması için veri işlemenin zorunlu olması halinde;

- Hukuk işlerinin takibi,
- Talep ve şikâyetlerinin takibi amacıyla

Açık rızanın varlığı halinde;

- Şirketimizin sunduğu, aracılık ettiği ürün ve hizmetlerin kişiye özel olarak sunulması, pazarlama analizlerinin ve modellemelerinin yapılarak bu kapsamda tarafınızla iletişime geçilmesi,
- Ürün ve hizmetlerimize ilişkin kişiye özel tekliflerin paylaşılması,
- Ürün ve hizmetlerin çapraz satışına yönelik faaliyetlerin yürütülmesi,
- Müşteri kazandırma çalışmalarının gerçekleştirilmesi,
- Kampanya veya promosyon süreçlerinin planlanması veya icrası,
- Şirket faaliyetleri kapsamında yapılması gerekli görülen analiz ve modelleme çalışmalarının yürütülmesi ve incelemelerin yapılması,
- Müşteri memnuniyetine yönelik aktivitelerin yürütülmesi amacıyla,
- Şirketin içerisinde bulunduğu grup şirketleri ile birlikte sunulan ürün ve hizmetlerin tanıtımının yapılması ve kullanımının artırılmasına yönelik faaliyetlerin planlanması ve icrası,
- Şirketin içerisinde bulunduğu grup şirketlerinin ürün ve hizmetlerinin pazarlama aktivitelerin planlanması ve icrası

amaçlarıyla, 6698 sayılı Kanun’un 4. maddesinde belirtilen ilkeler dahilinde işlenmektedir.

Kişisel Verilerinizin Toplanma Yöntemi ve Hukuki Sebebi; Kişisel Verileriniz, hem tamamen veya kısmen otomatik yollarla hem de bir veri kayıt sisteminin parçası olan ancak otomatik olmayan yöntemlerle;
‍
Doğrudan sizin tarafınızdan veya sizin adınıza hareket etmeye yetkili kişiler tarafından; anlaşmalı internet siteleri üzerinden yapılmış olan başvurular, şube ve UPT genel müdürlük personeli, internet sitemiz, mobil uygulamamız, çağrı merkezlerimiz ve diğer telefon kanallarımız, sözleşmeler, SMS, elektronik posta, faks, posta, kargo ya da kurye hizmetleri gibi Şirketimizin faaliyetlerinin tamamlayıcısı veya uzantısı niteliğindeki hizmetler aldığı taraflar vasıtasıyla, medya, sosyal medya hesaplarımız, kayıtlı elektronik posta, elektronik tebligat, anlaşmalı kuruluşlar ve destek hizmeti ve dış hizmet kuruluşları vasıtasıyla ve ilgili mevzuatın ve yapılan anlaşmaların izin verdiği ölçüde benzeri kurum ve kuruluşların veri tabanları, çerezler ve benzeri takip teknolojileri, ticaret odası ve esnaf odaları gibi birlik ve dernekler aracılığıyla, fiziksel mekan güvenliği uygulamaları sebebiyle şube ve UPT genel müdürlük binalarımızda kamera görüntülerinin kaydedimesi yöntemiyle, muhabir/muhatap bankalar, müşteri görüşmeleri, üye işyerleri ve POS'ları, SGK kayıtları, ulusal ve uluslararası otoriteler/merciler/kurumlar yasal mevzuat sınırları içerisinde Şirketimiz ile kamu kurum ve kuruluşları arasındaki sistem entegrasyonlarıyla (Kimlik Paylaşım Sistemi, Adres Paylaşım Sistemi, Ticaret Sicil Gazetesi vb.) ve SWIFT gibi uluslararası para transferi aracılığı ile Şirketimize yapılan her türlü bildirimler, başvurular, görüşmeler ve benzeri/sair kanallar aracılığıyla sözlü, yazılı veya elektronik ortamlarda;

6698 sayılı Kanun’un;
‍
- 5/1 ve 6/2 maddeleri uyarınca açık rızanızın olması,
- 5/2-a maddesinde belirtilen kanunlarda açıkça öngörülmüş olması,
- 5/2-b maddesinde belirtilen fiili imkânsızlık nedeniyle rızasını açıklayamayacak durumda bulunan veya rızasına hukuki geçerlilik tanınmayan kişinin kendisinin ya da bir başkasının hayatı veya beden bütünlüğünün korunması için zorunlu olması,
- 5/2-c maddesinde belirtilen sözleşmenin kurulması veya ifası için gerekli olması kaydıyla, sözleşmenin taraflarına ait kişisel verilerin işlenmesinin gerekli olması,
- 5/2-ç maddesinde belirtilen Şirketimizin hukuki yükümlülüğü yerine getirebilmek için zorunlu olması,
- 5/2-d maddesinde belirtilen Tarafınızca alenileştirilmiş olması,
- 5/2-e maddesinde belirtilen bir hakkın tesisi, kullanılması veya korunması için işlemenin zorunlu olması,
- 5/2-f maddesi uyarınca, temel hak ve özgürlüklerinize zarar vermemek kaydıyla, Şirketimizin meşru menfaati için işlemenin zorunlu olması,

hukuki sebeplerine dayanarak işlenebilmektedir.

Yukarıda belirtilen amaçlarla, kişisel verilerin aktarılabileceği kişi/kuruluşlar; Kişisel verilerinize 6698 sayılı Kanun’un 8. ve 9. maddesinde belirtilen veri aktarma ve işleme şartları ile yukarıda sayılan amaçların gerçekleştirilmesini sağlamak amacı ile mevzuatta belirlenen güvenlik ve gizlilik esasları uyarınca yeterli ve etkili önlemler alınmak kaydıyla; UPT’nin yurt içi ve yurt dışındaki iş ve çalışma ortaklarına, hissedarlarına, iştiraklarine, alt yapı hizmet sağlayıcılarına, bulut bilişim sistemleri sağlayıcılarına ve yargı mercileri ile benzeri kanunen yetkili kamu/özel kurum ve kuruluşlara, muhabir bankalara aktarılabilecektir.

6698 sayılı Kanun’un 11. Maddesinde Sayılan Haklarınız; Kişisel veri sahipleri olarak, haklarınıza ilişkin taleplerinizi aşağıda düzenlenen yöntemlerle iletmeniz durumunda UPT talebin niteliğine göre talebi en kısa sürede ve en geç otuz gün içinde sonuçlandıracaktır. Verilecek cevapta on sayfaya kadar ücret alınmayacaktır. On sayfanın üzerindeki her sayfa için 1 Türk Lirası işlem ücreti alınacaktır. Başvuruya cevabın CD, flash bellek gibi bir kayıt ortamında verilmesi halinde Şirketimiz tarafından talep edilebilecek ücret, kayıt ortamının maliyetini geçmeyecektir.

UPT tarafından işlenen kişisel verilerinize ilişkin olarak 6698 sayılı Kanun’un 11. maddesi uyarınca;
‍
- Kişisel verilerinizin işlenip işlenmediğini öğrenme,
- Kişisel verileriniz işlenmiş ise buna ilişkin bilgi talep etme,
- Kişisel verilerinizin işlenme amacını ve bunların amac uygun kullanılıp kullanılmadığını öğrenme,
- Yurt içinde ve yurt dışında kişisel verilerinizin aktarıldığı 3. kişileri öğrenme,
- Kişisel verilerinizin yanlış veya eksik işlenmesi halinde bunların düzeltilmesini isteme,
- Kişisel verilerinizin işlenmesini gerektiren sebeplerin ortadan kalkması halinde silinmesini talep etme,
- Kişisel verilerinizin münhasıran otomatik sistemler vasıtasıyla analiz edilmesi nedeniyle aleyhinize bir sonucun ortaya çıkmasına itiraz etme,

Talebinizin niteliğine göre kimlik tespitine olanak sağlayacak bilgi ve belgelerin eksiksiz ve doğru olarak tarafımıza sağlanması gerekmektedir.
